In the first part, we will provide an update on recent case law related to environmental claims, including statements such as “climate neutral.” This will include taking a look at intersections with public legal enforcement in this area (Germany has a focus on private enforcement), and we will also briefly explore how similar cases are being assessed in other countries.
In the second part, we will dive into the EmpCo Directive, which will significantly change how environmental claims can be advertised from September 2026, as generic environmental claims and sustainability labels will be subject to new regulations. It is advisable for companies to start preparing early for these changes.
Still pending is the Green Claims Directive, which may also have far-reaching implications for businesses and their use of environmental claims in advertising. We will also provide an overview of this legislative proposal.
