ARCON’s new event – Do we need panel of judges specialized in competition law?

The Romanian Association for Competition Law (ARCON), together with Universul Juridic publishing house, organizes a new debate on whether the courts competent to hear cases on competition law should have specialized panels of judges. The debate will bring together not only reprezentatives of the business environment in Romania, but also reprezentatives of the institutions competent to make a change. Therefore, the panel includes the Ministry of Justice, two former ministries of justice, the president of the special committee among the Parliament entrusted with the review of any amnendments to the existing legal framework, the vice-president of the Competition Council and judges from the High Court of Cassation of Justice. We are glad to inform you that the questions to be discussed during the London congress are as follows :

  • Question A: What progress has been made, and is still to be made, in ensuring effective redress for harm resulting from infringements of competition law?

Background & Context:
It is generally accepted that private enforcement has an important role in increasing the effective functioning of competition regimes globally and that individuals and/or firms who suffer harm as a result of anti-competitive conduct should be entitled to compensation for their loss(es). Consequently, interest in, and the significance of, this aspect of the competition law ‘toolkit’ continues to grow.

There have been a number of initiatives in various jurisdictions to promote more private enforcement and provide the necessary legal and economic framework for this purpose. For example, in November 2014, the EU Damages Directive, which harmonised certain procedural rules for competition damages actions across all EU Member States (including the United Kingdom at the time) and sought to establish a level playing field across the EU, entered into force. Together with the 2013 Recommendation on Collective Redress, the Damages Directive was intended to make it easier for victims of anti-competitive conduct to obtain compensation.
During the past decade, the use of private enforcement of competition law has increased throughout Europe and beyond. However, the intensity and experience of private enforcement is very mixed. Some jurisdictions have considerable experience in dealing with damages actions, however, in others private actions are rare.

Major differences still exist among jurisdictions, even between the EU Member States. For example, in a number of Member States, there have not yet been any court rulings applying the provisions of the Damages Directive and, for temporal application reasons, many rulings are still based on pre-existing national law.

The 10th Anniversary of the EU Damages Directive provides the LIDC with an opportunity to take a critical look at how private enforcement has evolved around the world, taking stock of the progress that has been made and what obstacles remain, considering how these might be overcome to ensure: effective redress; and a balance between public and private enforcement.

National groups are invited to provide an account of the emerging practices and trends in private enforcement of competition law in their respective jurisdictions from a legal and economic perspective, reflecting on various factors such as: the relevant legal instruments; institutional developments; applicable jurisprudence; the relevant procedural, legal and economic framework; and key practical and litigation issues.

As announced previously, Andras M. Horvath has been appointed as International Rapporteur for Question A.

For those who have not already done so, we kindly invite you to designate your National Rapporteur for Question A and inform the LIDC as soon as possible and in any event no later than 15 December 2023.

  • Question B:  How should we approach copycat packaging ? 

Do registered designs file against copycats and on what legal basis (IP and/or Unfair Competition Law)?

International Rapporteur, Prof. Ilanah Fhima has agreed to be the International Rapporteur for Question B.

LIDC / CLA Lunchtime Webinar:  – Foreign Subsidy Regime – Tuesday 11 July, 1:00 pm (CET) / midday (UK)

The LIDC will be holding a joint lunchtime webinar with the CLA on Tuesday 11 July 2023 at 1:00 pm (CET) / midday (UK).

Martin Farley, a member of the Legal Service of the European Commission, Natura Gràcia and Jacques Derenne have kindly agreed to speak on the subject of the Foreign Subsidy Control Regime: reflections from the UK and Europe. 

The Implementing Regulation will have been adopted shortly before the webinar (the ex-officio  investigation powers of the European Commission will be applicable as of 12 July 2023) and it will be the best opportunity for Martin Farley, having contributed to the legal review of this new EU Foreign Subsidy Control regime, to describe the rules and comment on them. Natura Gràcia and Jacques Derenne will share then their reflections on the new subsidy control regime, including the theories of harm underpinning the regime, the significance of this policy development, its interaction with other legal areas and its practical implications for businesses.

The session will be moderated by Christophe Rapin (LIDC President).

Martin Farley has been a member of the competition law and State aid teams of the European
Commission Legal Service since 2014. Prior to that, he spent 6 years in private practice at an
international law firm. Martin holds an LLB in Law with European Legal Studies from King’s
College London and an LLM in European Law from the College of Europe. Martin is a Fellow of
the Centre of European Law at King’s College London, and was a member of the editorial board
of the Journal of European Competition Law and Policy (JECLAP) between 2016 and 2022.

Jacques Derenne is a Partner at Sheppard Mullin, a member of the Brussels and Paris bars
and the head of the EU Competition & Regulatory practice. Jacques has 35 years of EU
competition law experience across all areas, including mergers, cartels, abuses of dominance
and State aid. Jacques has developed his leading State aid experience acting for beneficiaries,
competitors, many Member States and investors before the European Commission, EU courts
and national courts. He is professor at the University of Liège, where he has been teaching
State aid law since 2006 (as well as at the Brussels School of Competition since 2011).

Natura Gràcia is a Partner at Linklaters LLP, qualified in Spain and England and Wales. Natura
has extensive experience in multinational transactions and matters and regularly advises clients
in diverse industry sectors including private equity/financial sponsors, healthcare, energy and
transport, on the application of EU competition, merger control, state aid and public
procurement rules. She acts on behalf of international clients to obtain regulatory approvals for
mergers in various jurisdictions and heads the Linklaters State aid practice.

AFEC Conference: “Competition law in the face of crises”

We are pleased to announce that AFEC is organizing a conference on June 6, 2023 from 2:00 pm to 6:30 pm at ICC, 33-43 avenue du Président Wilson, 75016 Paris.

How do competition law(s) and the bodies in charge of its enforcement react to the various crises (economic, health, war with its energy or logistic consequences, climate) that companies are facing and to which they have to adapt?

To what extent does competition law allow to overcome crises and/or does it constitute an obstacle, a brake to the initiatives of economic operators?

Has the competition law been able to show flexibility in order to allow operators to overcome crises?
Is it desirable to make the rules evolve in view of long-term challenges?

These are some of the questions that lawyers, judges, legal directors and public authorities will try to answer. The aim is not only to assess the adaptability of competition law and practices, but also to formulate proposals to better meet the challenges posed by crises.
